Pricing and Terms Agreement
Client agrees to pay a service charge of $75.00 for first hour and $18.75 for every 15 minutes after the first hour for Geek in a Flash, LLC to come to the Client's location to make the service call. The minimum charge for service is $75+tax (minimum hour service charge) and is due regardless of outcome of service. Geek in a Flash, LLC does not provide billing services to clients. If for any reason temporary credit is accepted by Geek in a Flash, LLC, there will be an additional charge of $15 for each 15 day period that Geek in a Flash, LLC is not paid. There is a $20 charge for returned checks. Geek in a Flash, LLC reserves the right to refuse service as well as to change fees and rates at any time without notice. Client agrees to pay Geek in a Flash, LLC for all charges at the time of service. Client agrees to release and hold harmless Geek in a Flash, LLC from any and all liability associated with the performance of service or the provision of parts, and acknowledges also that Geek in a Flash, LLC offers no explicit or implied warranty or guarantee on services performed or parts provided, other than the manufacturer's warranty. Client agrees to release and hold harmless Geek in a Flash, LLC from all liability for damage or loss as well as any incidental or consequential material or financial damage or loss that may result from the actions of Geek in a Flash, LLC, its agents or service representatives, even if Geek in a Flash has been advised of the possibility of such damages. To the extent that a state does not permit the exclusion or limitation of liability as set forth herein, Geek in a Flash’s liability is limited to the extent permitted by law in such states. Client grants Geek in a Flash, LLC, its agents and service representatives, access and permission to physically disassemble any and all computer systems, components, networks, and peripherals. Client grants Geek in a Flash, LLC, its agents, and service representatives, permission to perform modification to Client's home or office property for the purpose of installing or troubleshooting computer and networking hardware. Client grants Geek in a Flash, LLC, its agents and service representatives, permission to download and install software on Client's computer and network. Client grants Geek in a Flash, LLC, its agents and service representatives, permission to install hardware in Client's computer and network. The exclusive venues for all disputes arising out of or in connection with this agreement shall be the Courts of Blount County, Tennessee, and Client submits to jurisdiction in those courts. Client further agrees to pay all expenses and attorney’s fees associated with such litigation. Client agrees that the service technician is an independent contractor whose services were arranged for by Geek in a Flash, LLC and that Geek in a Flash, LLC does not have control over the manner in which the technician performs his or her services. Geek in a Flash, LLC strongly recommends that Client safeguard critical data by backing up said data prior to any services performed by Geek in a Flash, LLC as Geek in a Flash, LLC is not responsible for any data lost during any services performed. Unless specifically requested and provided as a paid service by Geek in a Flash, LLC, Client is responsible for any backup, archiving, or protective storage as well as restoration, if required, of Client's data. Geek in a Flash, LLC is a provider of billable on‐site services. Neither the signing of this agreement nor the performance of services by Geek in a Flash, LLC implies availability of telephone technical support. This document constitutes the entire agreement.
